Reproducing Items in Our Collections

Kuumbwa Jazz envisions a community where all people can experience the joy of music, and understand the value and legacy of jazz as an original American art form. Accordingly, we support the reproduction of our archives materials for research, education, and artistic productions for all materials in the public domain or materials covered by fair use policies under US Copyright Law. Please cite materials sourced from our archive "Courtesy of the Kuumbwa Jazz Archives”.

We welcome you to download images from our Omeka page for Academic Fair Use Purposes and do not charge licensing fees for the materials in our digital archives. We do ask that you cite the source of the image, including an acknowledgement that the item is housed in our database.

Kuumbwa Jazz owns the copyright for a significant portion of our collection, however, some items are owned in part or in whole by another copyright holder. The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted materials. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction.

One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of fair use, that user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law.

Please note that you assume all responsibility for any infringement of copyright laws in your use of the materials and agree to indemnify and hold harmless Kuumbwa Jazz Archives, its agents and employees against all claims, demands, costs, and expenses incurred by copyright infringement or any other legal or regulatory cause of action arising from the use of these reproductions.
